This Rental Agreement ("Agreement") is entered into by and between Fern Event Rentals ("Company") and the Renter. By submitting payment or signing this Agreement, the Renter agrees to the terms and conditions outlined below.

Agreement of Terms

By submitting the required 25% non-refundable deposit or signing this Agreement, the Renter acknowledges that they have read, understood, and agreed to all terms and conditions herein. This Agreement constitutes a binding contract between the Renter and Fern Event Rentals. Electronic payment or digital submission of this Agreement shall constitute a valid and binding signature to the same extent as a handwritten signature.

Confirming Your Rental

Order Accuracy

The Renter is responsible for verifying that all rental items, quantities, event dates, and times are correct. Same-day changes to items or rental times cannot be accommodated.

Order Adjustments

Any changes must be requested at least 72 hours prior to the event date and are subject to item availability and approval. Changes requested between 24 and 72 hours before the event are at Fern Event Rentals' sole discretion. Changes requested less than 24 hours before the event will not be accepted under any circumstances.

Right of Refusal

Fern Event Rentals reserves the right to refuse service to any individual or event at its discretion.

Payment

Deposit

A 25% non-refundable deposit is due at the time of booking. The event date is not secured until this payment is received. Accepted payment methods include credit/debit card, Venmo, Zelle, and cash. Personal checks are not accepted.

Final Balance

The remaining balance must be paid by the time of delivery.

Delivery

Location & Access

Delivery will be made to the address provided by the Renter. The Renter must ensure a clear, safe, and accessible path to the drop-off location (e.g., driveway, backyard, garage, or indoor space). Fern Event Rentals shall not be responsible for any damage to property, including but not limited to driveways, lawns, flooring, or landscaping, that occurs in the course of delivery or pickup, provided reasonable care is exercised.

Delivery Window

While we strive to arrive within the agreed-upon time window, delays may occur due to traffic, weather, or other unforeseen circumstances. Such delays do not constitute a breach of contract.

Customer Pickup

Scheduling

Renter-arranged pickups must occur at the scheduled time. The Renter must arrive within a 15-minute window before or after the scheduled pickup time.

Failure to Pick Up

If the Renter fails to arrive within the 15-minute pickup window, the rental may be considered forfeited at Fern Event Rentals' discretion, regardless of the reason for the delay. In such cases, the Renter will forfeit the 25% non-refundable deposit as well as the full remaining balance, and no refunds will be issued.

Third-Party Pickup

If a third party is picking up the rentals, the Renter must provide the individual's name and phone number in advance. The 15-minute pickup window still applies.

Pickup Readiness & Teardown

Item Preparation

For rentals scheduled for pickup by Fern Event Rentals, all items must be folded, stacked, and ready at the agreed-upon time.

Teardown Fee

Items not prepared for pickup may result in a teardown fee of $25 to $75 per occurrence, or an additional full-day rental charge, at Fern Event Rentals' discretion. The applicable fee will be communicated to the Renter at the time of pickup.

Large Installations

Only select items, such as flower walls and other large installations, will be assembled and disassembled by Fern Event Rentals. Once assembled, any installation cannot be moved from its setup location. Moving will result in additional fines up to $150.

Care of Equipment

Proper Use

All rental items must be used only for their intended purpose and handled with care.

Weather Protection

The Renter is responsible for protecting all items from weather exposure, including rain, wind, snow, and excessive moisture.

Damage & Loss

The Renter assumes full financial responsibility for any lost, stolen, damaged, or excessively soiled items, including but not limited to stains, burns, breakage, or missing parts. Damage will be assessed at replacement cost or repair cost, as determined solely by Fern Event Rentals. The Renter must notify Fern Event Rentals of any damage promptly and no later than the time of return or pickup.

Outdoor Events

For outdoor events, the Renter must have a weather contingency plan. Fern Event Rentals reserves the right to modify delivery or pickup schedules to protect staff and equipment.

Damage Payments & Item Ownership

In the event that a rental item is damaged, lost, or destroyed, the Renter agrees to pay the full replacement or repair cost as determined by Fern Event Rentals. Payment of any damage fee does not constitute a sale or transfer of ownership of any rental item. All rental items remain the sole property of Fern Event Rentals at all times. Damaged items must be returned to Fern Event Rentals in whatever condition they are in. The Renter may not retain any rental item, whether damaged, broken, or otherwise, under any circumstances. This is a rental agreement and not a sale agreement; no ownership rights are transferred to the Renter at any time. Failure to return any rental item, regardless of its condition, will result in additional charges equivalent to the full replacement value of the item.

Use of Images & Media

Fern Event Rentals reserves the right to photograph or record rented items before, during, or after the event and to use such images or videos for marketing, promotional, website, and social media purposes. This includes images of installations, décor, and event setups. If the Renter wishes to opt out of this use, written notice must be provided prior to the event date.

Cancellations

More Than 7 Days Prior

Cancellations made more than 7 days before the event will result in forfeiture of the 25% non-refundable deposit.

Within 7 Days

Cancellations made within 7 days of the event will result in forfeiture of 100% of the rental fee.

Severe Weather

In cases of severe or unsafe weather conditions, as determined solely at Fern Event Rentals' discretion, Fern Event Rentals will work with the Renter to explore rescheduling or partial refunds. The final determination of what constitutes severe weather and what remedies are available rests exclusively with Fern Event Rentals.

Force Majeure

Fern Event Rentals shall not be held liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, natural disasters, fire, flood, government restrictions, power outages, labor disruptions, or other emergencies. In such cases, Fern Event Rentals will make reasonable efforts to reschedule services or provide a partial refund at our discretion, but is not obligated to do so.
